Legal Information

Understanding the legal framework for property purchase in Gujarat — so you can buy with complete confidence.

Agreement to Sell (ATS)

The Agreement to Sell is the primary legal document entered into between the buyer and Mangla Group. It outlines the total consideration amount, payment schedule (linked to construction milestones), the specific unit purchased, the date of possession, penalty clauses for delay, and all terms of the transaction.

The ATS is signed after the initial booking amount is paid and KYC documents are submitted. It is stamped and registered as per the Indian Stamp Act and Registration Act — this makes it legally binding and enforceable.

Sale Deed

The Sale Deed is executed upon completion of the project and payment of all dues. It formally transfers ownership of the property from Mangla Group to the buyer. The Sale Deed must be registered at the local Sub-Registrar's office in the presence of both parties and two witnesses.

Stamp Duty and Registration fees are payable by the buyer and are calculated as a percentage of the higher of the agreement value or the jantri (circle rate) value. As of 2024, stamp duty in Gujarat is 4.9% and registration fee is 1% of the property value.

RERA Compliance

Under the Real Estate (Regulation and Development) Act, 2016, all ongoing and upcoming Mangla Group projects are registered with the Gujarat Real Estate Regulatory Authority (GujRERA). Our RERA registration numbers are available on request from our sales team, and can be verified on the GujRERA website.

RERA mandates that 70% of project collections are maintained in a dedicated escrow account for construction use — protecting your investment against misappropriation of funds.

Title Search

Before investing, buyers are encouraged to conduct a title search of the project land to verify ownership history and ensure there are no encumbrances (mortgages, legal disputes, or charges). Mangla Group's legal team can provide all relevant land documents including 7/12 extract, revenue records, and approved plans upon request.

Building Plan Approval

All Mangla Group projects are constructed only after receiving approved building plans from the Vadodara Urban Development Authority (VUDA) or the relevant municipal authority. The approved plans can be inspected at our sales office.

Occupancy Certificate (OC) and Completion Certificate (CC)

Upon completing construction, Mangla Group applies for the Occupancy Certificate (OC) and Completion Certificate (CC) from VUDA. These certify that the building has been constructed in accordance with the approved plans and is fit for occupation. Possession is handed over only after the OC is received.

Home Loan and Stamp Duty

If you are availing a home loan, your bank will conduct its own due diligence on the project documents, title, and RERA status before disbursing funds. Mangla Group projects are approved by all major nationalized banks and leading housing finance companies.
